Acceptance
By creating a MojoScale account or using MojoScale, you agree to these Terms. If you use MojoScale for a company or other organization, you confirm that you are authorized to accept these Terms on its behalf.
Service
MojoScale provides software, telemetry, gateway setup, monitoring, and related tools for connected equipment. The Service depends on third-party networks, controllers, sensors, cloud providers, device firmware, and customer configuration.
MojoScale is not an emergency response service, certified safety system, protection relay, shutdown system, or substitute for direct inspection, alarms, maintenance, supervision, or qualified operators.
Customer Responsibilities
You are responsible for equipment selection, installation, wiring, configuration, network access, credentials, local regulations, maintenance, and decisions made using telemetry or status data.
You must not use MojoScale where delayed, missing, incorrect, or unavailable data could cause death, personal injury, environmental damage, or property damage unless you have independent safety systems and procedures in place.
Accounts And Security
You are responsible for keeping your account, credentials, gateways, and devices secure. You must notify us promptly if you believe your account or equipment access has been compromised.
Data
You authorize MojoScale to receive, process, store, display, and transmit telemetry, device status, configuration, account, and operational data as needed to provide and improve the Service.
You are responsible for ensuring you have the rights and permissions needed to connect equipment and send data to MojoScale.
Acceptable Use
You may not misuse the Service, interfere with its operation, reverse engineer restricted components, attempt unauthorized access, transmit malicious code, overload systems, or use the Service for unlawful activity.
Third-Party Services
The Service may rely on third-party services such as hosting, authentication, communications, mapping, cloud storage, and messaging providers. MojoScale is not responsible for third-party outages, changes, errors, or security incidents outside its control.
No Warranties
To the fullest extent permitted by law, MojoScale is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or uninterrupted operation.
Limitation Of Liability
To the fullest extent permitted by law, MojoScale and its owners, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, equipment damage, downtime, business interruption, missed alarms, or operational losses.
To the fullest extent permitted by law, MojoScale's total liability for any claim related to the Service will not exceed the greater of the amount you paid to MojoScale for the Service in the 12 months before the event giving rise to the claim or 100 US dollars.
Some laws do not allow certain exclusions or limitations. In those cases, liability is limited to the fullest extent permitted by law.
Indemnity
You agree to defend, indemnify, and hold MojoScale harmless from claims, losses, liabilities, damages, costs, and expenses arising from your equipment, data, configuration, use of the Service, breach of these Terms, or violation of law or third-party rights.
Changes
MojoScale may update these Terms from time to time. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
Termination
MojoScale may suspend or terminate access to the Service if you violate these Terms, create risk, fail to pay applicable fees, or use the Service in a harmful or unlawful way.
Governing Law
These Terms are governed by the laws of the jurisdiction where MojoScale operates, without regard to conflict-of-law rules, unless applicable law requires otherwise.
